TERMS AND CONDITIONS OF USE

Last Modified: October 20, 2026

1. AGREEMENT AND DEFINITIONS

These Terms and Conditions (the "Terms") form a binding agreement between you and Veksler Inc. ("Veksler", "we", "us" or "our"), operating as Veksler Academy, for your enrolment in and use of the Facial Myofascial Techniques for Aging Support online course (the "Course").

By ticking the acceptance box at checkout, completing a purchase, or accessing any part of the Course, you confirm that you have read, understood and agree to these Terms and our Privacy Policy. If you do not agree, do not purchase or access the Course.

In these Terms:

  • "Course Materials" means all videos, recordings, live session replays, workbooks, handouts, protocols, techniques, images, text, and other content provided as part of the Course.
  • "Access Period" means the 8-week period described in Section 3.
  • "Platform" means Kajabi, or any other platform we use to deliver the Course.
  • "Community" means the private group for Course students hosted on the Platform.
  • "Student" or "you" means the individual who enrols in the Course.

We may update these Terms from time to time. The version in force at the time of your purchase applies to your enrolment, except that changes required by law or relating to Community conduct apply from the date they are posted.

2. ELIGIBILITY AND YOUR ACCOUNT

You must be at least 18 years old, or the age of majority where you live if that is higher, to enrol. By enrolling you confirm that you meet this requirement and have the legal capacity to enter into these Terms.

Your enrolment is personal to you. You may not share your login, transfer your enrolment, or allow anyone else to access the Course or the Community through your account. We may suspend or end access without refund if we reasonably believe an account is being shared.

You are responsible for keeping your login details secure and for providing accurate information at enrolment, including your full legal name as you want it to appear on your certificate.

The Course is taught in English. You are responsible for making sure your English is sufficient to follow the Course Materials and live sessions.

3. COURSE FORMAT AND ACCESS

The Course is delivered online through the Platform. It consists mainly of pre-recorded video lessons, plus two live question-and-answer sessions.

Course content. The Course is made up of a Welcome Module, a series of teaching modules covering the theory and hands-on facial myofascial techniques taught in the Course, two live Q&A sessions, and a final exam. The module titles and outline are shown on the Course sales page and inside the Platform. The Course content is designed to be completed over 5 weeks from the Course Start Date. Your 8-week Access Period gives you additional time to review the material, practise the techniques, and complete the final exam and certificate requirements.

Release schedule. The Welcome Module is available immediately after your purchase is completed. Module 1 is released on the Course start date shown at checkout (the "Course Start Date"). Each following module unlocks automatically once you have completed the previous one. You must complete the modules in order; you cannot skip ahead.

Late enrolment. Enrolment remains open until 11:59 p.m. Eastern Time on the last day of week 1 after the Course Start Date, unless we close it earlier (for example, if the Course is full). If you enrol after the Course Start Date, the Welcome Module and Module 1 are available immediately and the remaining modules unlock as described above. Your Access Period, final exam deadline and certificate deadlines still run from the original Course Start Date, not from the date you enrolled, so you will have less time than students who enrolled before the Course Start Date. By enrolling late, you accept this, and it is not grounds for a refund or an extension.

Final exam. The final exam is graded automatically on the Platform. You may retake it as many times as you need until you pass, as long as you pass no later than 11:59 p.m. Eastern Time on the last day of week 7 after the Course Start Date. Attempts after the deadline will not be accepted, and no certificate will be issued without a passing exam completed on time. Missing the deadline is not grounds for a refund or an extension.

Access Period. You will have access to the Course Materials and the Community for 8 weeks from the Course Start Date. When the Access Period ends, your access to the Course Materials, live session replays and Community ends automatically. Extensions are not guaranteed and are at our sole discretion.

Live sessions. We will announce the dates and times of the two live Q&A sessions in advance, in Eastern Time (ET). We cannot guarantee the times will suit every time zone. If you cannot attend, a recording will be available for the rest of your Access Period. We may reschedule a live session for reasons outside our control and will give as much notice as reasonably possible.

Technical requirements. You are responsible for having a suitable device, internet connection and software to access the Platform. We are not responsible for access problems caused by your equipment, internet provider or the Platform's own outages, although we will make reasonable efforts to help.

Changes to content. We may update, reorder or improve the Course Materials during the Access Period, provided the overall substance of the Course is not materially reduced.

4.FEES AND PAYMENT

Price. The Course fee is the amount shown on the checkout page at the time of your purchase. All prices and charges are in U.S. dollars (USD). If your card or bank account is in another currency, your bank or card issuer may apply its own exchange rate and conversion fees, which are your responsibility. Prices may change at any time, but a change will not affect a purchase you have already completed.

Taxes. Canadian residents will be charged applicable Canadian sales tax (such as HST, GST or PST) on top of the Course fee. Students outside Canada are responsible for any taxes, duties, currency conversion fees or bank charges imposed in their own country.

Payment options. You may pay either:

  •  in full at checkout; or
  • in two instalments, with the first charged at checkout and the second charged automatically on the date shown at checkout.

By choosing the instalment plan, you authorise us and our payment processor to charge the second instalment to the payment method you provided. You agree to pay the full Course fee whichever option you choose. The instalment plan is a way of paying for the whole Course, not a subscription you can cancel part-way.

Failed payments. If your second instalment fails or is declined, we may suspend or remove your access to the Course, the Community and any live sessions immediately until payment is received. No certificate will be issued until the full Course fee is paid. The unpaid balance remains owing, and we may take reasonable steps to recover it.

Chargebacks. If you believe a charge is wrong, please contact us at support@vekslersystem.com before contacting your bank. Filing a chargeback or payment dispute for a valid charge is a breach of these Terms. We may remove your access immediately and provide evidence of your purchase, your acceptance of these Terms, and your use of the Course to the payment provider.

5. NO REFUNDS

All sales are final. Because the Course is digital content that is made available to you immediately, we do not offer refunds, credits or exchanges for any reason, including if you change your mind, do not complete the Course, do not attend the live sessions, do not use the Course Materials, or do not meet the certificate requirements within the Access Period.

Immediate access and withdrawal rights. By completing your purchase, you expressly request that we give you access to the Course immediately, and you acknowledge that once access is granted you lose any statutory right to cancel or withdraw from the purchase that would otherwise apply, to the extent permitted by the law of your country (including the EU and UK 14-day cancellation rules for digital content).

Nothing in these Terms limits any right to a refund that cannot be excluded under the consumer protection laws that apply to you. If we cancel the Course entirely before you have received it, we will refund the amount you paid for it.

6. CERTIFICATE OF COMPLETION

A certificate of completion is issued only when all of the following are met within the 8-week Access Period:

  1. the full Course fee has been paid;
  2. you have completed the Course requirements we set out in the Course Materials, including passing the final exam by the deadline in Section 3; and
  3. you have submitted all information and materials we request for certification (such as your legal name, assignments, practice videos or case photos) in the required format.

It is your responsibility to submit everything needed on time. We are not obliged to issue a certificate, or to review late submissions, after the Access Period ends. Missing the deadline is not grounds for a refund.

What the certificate means. The certificate confirms that you completed a private educational course offered by Veksler Inc. It is not a government licence, professional licence, accreditation, diploma or regulatory qualification. It does not authorise you to practise any regulated profession or give you any right to perform treatments where a licence is required (see Section 8).

What the certificate does not permit. The certificate does not authorise you to teach, train, certify or instruct others in the techniques taught in the Course (see Section 7).

We may revoke a certificate if it was obtained through false information or if you seriously breach these Terms.

7. INTELLECTUAL PROPERTY

All Course Materials, and the methods, protocols, names, logos and branding of Veksler Inc. and Veksler Academy, are owned by or licensed to Veksler Inc. and are protected by copyright, trademark and other laws.

Your licence. We grant you a personal, non-exclusive, non-transferable, revocable licence to view the Course Materials during the Access Period for your own learning, and to use the techniques you learn to perform treatments on your own clients in your own practice.

You may not:

  • teach, train, coach, mentor or certify any other person in the techniques, protocols or methods taught in the Course, whether paid or free, in person or online, in full or in part;
  • create, sell or deliver any course, workshop, masterclass, tutorial, video series, e-book or similar product that is based on, copies or adapts the Course Materials or methods;
  • download, screen-record, photograph, copy, reproduce, translate, distribute, post or resell any Course Materials or live session recordings;
  • share Course Materials or Community content with anyone outside the Course, including on social media; or
  • use the names "Veksler", "Veksler Academy" or "Face Fitness System", or our logos, in a way that suggests you are affiliated with, endorsed by or a representative of Veksler Inc., except to state truthfully that you completed the Course.

You may post your own before-and-after results and your own client work, provided you do not reveal step-by-step protocols from the Course.

Breaching this Section causes us serious harm. We may end your access and revoke your certificate without refund, and seek an injunction, damages and our legal costs. This Section continues to apply after your Access Period ends.

8. USING THE TECHNIQUES ON CLIENTS

The Course teaches manual (hands-only) facial techniques that you may use on clients. It does not teach any medical, injectable, device-based or invasive procedure.

Licensing is your responsibility. Rules on who may touch or treat a client's face for payment differ by country, state and province. In many places, including many U.S. states, you may need an esthetician, cosmetology, massage or other licence to provide facial treatments to the public. Before offering any treatment, you are solely responsible for confirming and holding every licence, permit, registration and business approval required where you practise. Our certificate does not replace any of them.

Insurance. You are responsible for holding appropriate professional liability and general liability insurance before treating clients.

Client care. You are solely responsible for every treatment you provide, including:

  • taking a health history and screening each client before every treatment;
  • obtaining the client's informed consent;
  • following hygiene and sanitation standards that apply where you practise;
  • refusing or adapting treatment where it may be unsafe, and referring the client to a doctor when in doubt; and
  • your own record-keeping, pricing, marketing claims and compliance with consumer and advertising laws.

Contraindications. The Course explains contraindications and precautions in more detail. As a minimum, you must not perform treatments, or must first obtain written clearance from the client's doctor, where the client has or recently had any of the following:

  • an active skin infection, cold sore, open wound, unhealed lesion, or active inflammatory condition on the face (such as flaring acne, eczema, dermatitis or rosacea);
  • facial injectables (such as neurotoxins or dermal fillers) or thread lifts, within the waiting period advised by the injecting practitioner, and in any case within the last 2 weeks;
  • facial or dental surgery, or a facial fracture, that has not fully healed with the surgeon's or dentist's clearance;
  • a chemical peel, laser, microneedling or similar in-clinic treatment within the last 2 weeks, or sunburn;
  • fever, contagious illness or general feeling of being unwell;
  • active cancer or cancer treatment, or any undiagnosed lump or swelling in the face or neck;
  • a blood clotting disorder, use of blood-thinning medication, or a history of blood clots;
  • uncontrolled high blood pressure or a serious heart condition;
  • an acute facial nerve condition (such as Bell's palsy in its early phase or trigeminal neuralgia) or a TMJ (jaw joint) disorder;
  • pregnancy; or
  • any other condition for which the client's doctor has advised against facial massage.

This list is not complete. When in doubt, do not treat.

9. HEALTH DISCLAIMER AND RESULTS

The Course is for educational purposes only. It is not medical advice, diagnosis or treatment, and it does not create a nurse-patient, doctor-patient or any other healthcare relationship between you (or your clients) and Veksler Inc. or any instructor, even where an instructor holds a healthcare qualification.

If you practise the techniques on yourself, you do so at your own risk. Consult your doctor before starting if you have any of the conditions listed in Section 8.

No guarantee of results. Results from facial techniques vary from person to person and depend on factors such as age, skin, genetics, lifestyle and consistency. Any before-and-after photos, testimonials or results shown in our marketing or in the Course are examples only and are not typical or guaranteed. We do not guarantee that you will achieve any particular result for yourself or your clients, or that you will earn any particular income from using the techniques.

You must not make medical claims, or claims that the techniques replace medical or injectable treatments, when marketing your own services.

10. COMMUNITY, RECORDINGS AND MARKETING USE

Community conduct. The Community is for respectful learning. You must not post anything abusive, discriminatory, harassing, misleading or unlawful; promote your own or anyone else's products, services or courses; solicit other students; share other students' personal information or content outside the Community; or post photos of clients without their written consent. We may remove posts and suspend or remove any member, without refund, at our discretion.

Recording of live sessions. Live Q&A sessions are recorded and made available to students for the rest of the Access Period. By joining a live session, you consent to being recorded, including your name, image, voice and anything you say, type or show. If you do not want to appear, you may keep your camera off, use your first name only, and submit questions in writing.

Content you share. You keep ownership of the photos, videos, comments, results and other content you post in the Community, submit for your certificate, or send to us ("Your Content"). You confirm that you have the right to share Your Content, including written consent from any client who appears in it.

Testimonials and marketing consent. You grant Veksler Inc. a worldwide, royalty-free, non-exclusive, perpetual licence to use, reproduce, edit (for length and format only) and publish Your Content, and the live session recordings in which you appear, together with your first name and initial and your general location, in our marketing, websites, social media, advertising and course materials. We will:

  • only publish testimonials that reflect your honest opinion and experience, and never alter their meaning;
  • not publish your full name, client photos or a recognisable image of your face for marketing without asking you first; and
  • disclose any payment, discount, free access or other benefit you received in exchange for a testimonial.

You may withdraw this consent at any time for future use by emailing support@vekslersystem.com. We will stop new uses within a reasonable time, but we are not required to remove content already published or printed.

You receive no payment for this use unless we agree otherwise in writing.

11. LIABILITY, TERMINATION AND GENERAL TERMS

Limitation of liability. To the fullest extent permitted by law, Veksler Inc., its directors, employees, instructors and contractors are not liable for any indirect, incidental, special or consequential loss, including loss of income, business or reputation, or any injury, loss or claim arising from treatments you perform on yourself or others. Our total liability to you for any claim relating to the Course is limited to the amount you paid for the Course. Nothing in these Terms excludes liability that cannot be excluded by law.

Indemnity. You agree to indemnify and hold harmless Veksler Inc. and its directors, employees, instructors and contractors from any claim, loss, damage or cost (including reasonable legal fees) arising from treatments you provide to clients, your breach of these Terms, your failure to hold any required licence or insurance, or Your Content.

Ending your access. We may suspend or end your access without refund if you breach these Terms, fail to pay, share your account, misuse the Course Materials, or behave in a way that harms other students or our business. Sections 4 (unpaid amounts), 5, 7, 8, 9, 10 and 11 continue to apply after your access ends.

Events outside our control. We are not responsible for any delay or failure to deliver any part of the Course caused by events beyond our reasonable control, including illness or unavailability of an instructor, Platform or internet outages, natural disasters, public health emergencies or government action. In that case we may reschedule live sessions, adjust release dates or extend the Access Period by a reasonable amount. These steps do not entitle you to a refund.

Privacy. We collect and use your personal information as described in our Privacy Policy at www.vekslersystem.com/privacy.

Emails and communications. By enrolling, you agree that we may contact you by email and through the Platform about your enrolment, payments, the Course, live sessions and your certificate. These service messages are part of the Course and you cannot opt out of them while enrolled. We may also send you marketing emails about our other programmes and offers. You can unsubscribe from marketing emails at any time using the link in each email.

Resolving disputes. If you have a concern or complaint about the Course or a charge, you agree to first contact us at support@vekslersystem.com and give us at least 30 days to try to resolve it informally before starting any legal proceedings or payment dispute.

Governing law. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. You and we agree to the exclusive jurisdiction of the courts of Toronto, Ontario, except where the consumer laws of your country give you a non-waivable right to bring a claim in your local courts.

General. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to a successor business. These Terms, the checkout page and the Privacy Policy are the entire agreement between us about the Course. If these Terms are translated, the English version prevails.
